The French Legal System

Unlike English-speaking countries, which use a system of “Common Law”, France like much of the rest of the world, has a system of “Civil law”. The basis of the French legal system is laid out in a key document originally drawn up in 1804, and known as the Code Civil, or Code Napoléon. There are other codes, including notably the Code Pénal, or Penal code, which defines criminal law.

There is no jury system in France. Cases are heard by a ‘tribunal’ which is composed of 6 lay judges and 3 professional judges. If two-thirds of the panel agree then the verdict is carried. Reforms brought forward by the former President Nicholas Sarkozy, attempted to introduce Anglo-American innovations, such as trial by jury. However, these reforms have since been abandoned by the Hollande administration, which considered trial by jury to be unduly time consuming and prohibitively costly.

Through Article 55 of the French Constitution, international rules take precedence over domestic laws, though the Constitutional Council can be asked to verify whether a treaty is consistent with the French Constitution. In Administration des Douanes v Société ‘Cafes Jacques Vabre’ and Raoul Georges Nicolo, the French courts recognised the supremacy of European Union law. However, some forms of EU law, such as Directives, require transposition into national law and are not considered to be generally directly effective.
